The Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, provides a mechanism for
copyright holders to request removal of infringing content and for parties whose content
has been wrongly removed to submit counter-notices.
TheJMStudios respects the intellectual property rights of others and expects users of the
Services to do the same. If you believe that content available through the Services infringes
upon your copyright, you may submit a DMCA takedown notice as described below.
False claims carry serious consequences. Under 17 U.S.C. § 512(f), any person
who knowingly materially misrepresents that material is infringing — or that material was
removed by mistake — may be subject to civil liability, including costs and attorneys' fees.
Submit notices only if you have a good-faith belief that your rights have been infringed.
If you are a copyright owner, or authorised to act on behalf of one, and you believe that
content within the Services infringes your copyright, you may submit a written DMCA notice
to our designated copyright agent. Your notice must include all of the following elements
to be considered valid:
-
Identification of the copyrighted work — a description of the copyrighted
work
you claim has been infringed, or a representative list if multiple works are affected.
-
Identification of the infringing material — a description of the material
you claim is infringing and sufficient information for us to locate it (e.g., a URL or
specific location within the Services).
-
Your contact information — your name, mailing address, telephone number,
and email address.
-
Good-faith statement — a statement that you have a good-faith belief that
the disputed use is not authorised by the copyright owner, its agent, or the law.
-
Accuracy statement — a statement, made under penalty of perjury, that the
information in your notice is accurate and that you are the copyright owner or authorised
to act on the copyright owner's behalf.
-
Signature — a physical or electronic signature of the copyright owner or
an authorised representative.
Incomplete notices may not receive a response. TheJMStudios reserves the right to request
additional information before acting on any notice.
If you believe that material has been removed or disabled as a result of a mistake or
misidentification, you may submit a counter-notice to our copyright agent. A valid
counter-notice must include all of the following:
-
Identification of the removed material — a description of the material
that was removed and its location before removal (e.g., a URL or screen location).
-
Your contact information — your name, mailing address, telephone number,
and email address.
-
Consent to jurisdiction — a statement that you consent to the jurisdiction
of the federal court in your district (or, if outside the United States, the jurisdiction
of the courts in the relevant territory).
-
Good-faith statement — a statement under penalty of perjury that you
have a good-faith belief that the material was removed as a result of a mistake or
misidentification.
-
Signature — a physical or electronic signature.
Upon receipt of a valid counter-notice, TheJMStudios may restore the removed material
after providing the original complaining party with a copy of the counter-notice and
a reasonable waiting period in accordance with the DMCA.
TheJMStudios reserves the right, in its sole discretion, to terminate access to any part
of the Services for users or parties who are found to be repeat infringers of intellectual
property rights, or who are subject to multiple valid DMCA notices within any reasonable
time period.
TheJMStudios will not tolerate repeated or wilful copyright infringement and will take
appropriate action, which may include pursuit of legal remedies under applicable law.
TheJMStudios actively monitors for unauthorised use of its intellectual property. If
TheJMStudios discovers that its copyrighted content — including the Meridix Compass
application, logo, branding, artwork, or website materials — has been reproduced,
distributed, or used without authorisation, TheJMStudios reserves the right to:
- Issue DMCA takedown notices to platform providers, hosting services, and app stores.
- Pursue civil remedies under applicable copyright law.
- Seek injunctive relief and monetary damages where appropriate.
- Report infringement to relevant authorities.
